These Terms of Sale apply to all purchases of goods made by you directly from ElectroDirect via our website www.electrodirect.com.au. By placing an order, you agree to be bound by these Terms of Sale.

1. Order Acceptance and Contract Formation

• Offer to Purchase: When you place an order, you are making an offer to purchase the selected products at the price set out on our website.

• Order Confirmation: After placing an order, you will receive an automated email acknowledging your request. This email is an acknowledgment of receipt, not an acceptance of your order.

• Acceptance: A contract between you and ElectroDirect is only formed when we have approved your payment, verified your details, and dispatched your goods. We will send you a dispatch confirmation email at this point.

• Right to Refuse: We reserve the right to decline or cancel any order for any reason, including but not limited to product unavailability, errors in pricing or product descriptions, or suspected fraud. If we cancel your order, we will issue a full refund.

2. Pricing and Payment

• Currency: All prices are in Australian Dollars (AUD) and are inclusive of GST.

• Payment Processing: Full payment is required at the time of order placement. We use secure third-party payment gateways. ElectroDirect does not store your complete credit card information.

• Fraud Prevention: Orders may be subject to security checks. We may contact you to verify your identity before processing an order to protect against fraudulent transactions.

3. Availability and Backorders

• While we strive to maintain accurate stock levels, appliances can occasionally be out of stock or discontinued by the manufacturer.

• If a product you ordered is unavailable, we will contact you as soon as possible to offer a suitable alternative, place the item on backorder, or provide a full refund.

4. Delivery Procedures

• Delivery Fees: Shipping costs are calculated at checkout based on the size, weight of the appliances, and your delivery address.

• Receiving Goods: You, or a nominated representative over the age of 18, must be present to accept the delivery. If no one is available, the courier may return the goods to the depot, and a re-delivery fee may apply.

• Site Access: It is your responsibility to ensure there is clear, safe access for our delivery personnel to bring large appliances into your premises.

• Title and Risk: Ownership of and risk of damage to the goods pass to you upon successful delivery to your nominated address.

5. Installation and Trades

• Installation Not Included: Unless explicitly stated otherwise on the product page or at checkout, the purchase price covers the product and delivery only. Installation and removal of old appliances are not included.

• Licensed Trades required: Many appliances require professional installation. For example, hardwired appliances like Arista brand induction cooktops, canopy rangehoods, or certain built-in ovens must be installed by a licensed electrician or plumber in accordance with Australian standards.

• Warranty Voidance: Failure to use a certified tradesperson for required installations may result in property damage, safety hazards, and the voiding of the manufacturer's warranty.

6. Statutory Guarantees and Warranties

• Australian Consumer Law (ACL): Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

• Manufacturer Warranties: In addition to your rights under the ACL, many products carry a manufacturer's warranty. Please retain your tax invoice as proof of purchase, as it will be required to make a warranty claim with the manufacturer.

7. Limitation of Liability

To the extent permitted by law, ElectroDirect’s liability for any breach of these Terms of Sale or a statutory guarantee is limited, at our option, to:

• The replacement of the goods or the supply of equivalent goods;

• The repair of the goods;

• The payment of the cost of replacing the goods or acquiring equivalent goods; or

• The payment of the cost of having the goods repaired.

8. Governing Law

These Terms of Sale are governed by the laws of [Insert Australian State, e.g., New South Wales / Victoria]. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts of that State.
